Terms and Conditions

These Terms and Conditions ("Terms", "Agreement") govern your access to and use of the FastDelivery website at fastdelivery.dev (the "Site") and the digital products we offer (collectively, the "Service"). By accessing the Site or purchasing our products, you ("Customer", "you", "your") agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

Please read these Terms carefully before making a purchase. By completing a purchase, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Agreement to Terms

By accessing or using our Service, you agree to be bound by these Terms and all applicable laws and regulations. If you disagree with any part of these Terms, you do not have permission to access the Service.

2. Description of Service

FastDelivery provides a digital product: a pre-built AWS Amplify Gen 2 + Next.js boilerplate/starter template for building SaaS applications. The product includes:

• Full source code access
• Documentation and setup instructions
• Pre-configured authentication system
• Payment integration setup
• AWS deployment configuration
• Lifetime access to the purchased version
• Future updates and improvements

3. Purchases and Payment

3.1 Pricing

The current price for FastDelivery is EUR 49.99 (one-time payment). Prices are subject to change at any time, but changes will not affect orders already placed.

3.2 Payment Processing

All payments are processed securely through Lemon Squeezy, our third-party payment processor. By making a purchase, you also agree to Lemon Squeezy's Terms of Service and Privacy Policy. We do not store your payment information on our servers.

3.3 Order Confirmation

After successful payment, you will receive an order confirmation and product delivery instructions via email. Please ensure you provide a valid email address during checkout.

3.4 Taxes

You are responsible for any applicable taxes, duties, or fees required by your jurisdiction. The listed price does not include any such charges unless explicitly stated.

4. Delivery

FastDelivery is a digital product delivered electronically. Upon successful payment:

• You will receive immediate access to download/access the product
• Delivery instructions will be sent to your email address
• Access is typically granted within minutes of purchase
• If you do not receive access within 24 hours, contact us at truesmarttech@truesmarttech.com

5. Refund Policy

Due to the nature of digital products and immediate delivery of the full source code upon purchase, we cannot offer refunds. Once you receive access to the code, we cannot revoke that access or prevent you from using it.

5.1 Exceptions

We may consider refunds in the following exceptional circumstances:

• Technical issues preventing access to the product (we will attempt to resolve the issue first)
• Duplicate charges due to processing errors
• Product was significantly misrepresented on our Site

Refund requests must be submitted within 7 days of purchase to truesmarttech@truesmarttech.com with a detailed explanation.

5.2 Chargebacks

If you initiate a chargeback or payment dispute without first contacting us to resolve the issue, we reserve the right to dispute the chargeback and may terminate your access to any future updates or support.

6. License and Usage Rights

6.1 License Grant

Upon purchase, you are granted a non-exclusive, non-transferable license to use the FastDelivery boilerplate code for:

• Building unlimited commercial or personal projects
• Modifying the code to suit your needs
• Using the code in client projects
• Deploying applications built with the boilerplate

6.2 License Restrictions

You may NOT:

• Resell, redistribute, or share the source code as a boilerplate or template
• Create competing products or services using our code
• Share your license or access credentials with others
• Publicly post the unmodified source code
• Use the FastDelivery name, branding, or trademarks without permission
• Remove copyright notices or attribution from the code

6.3 Updates and Support

Your purchase includes lifetime access to the purchased version and all future updates. However, we do not guarantee any specific updates or features. Technical support is provided on a best-effort basis via email.

7. Intellectual Property Rights

The FastDelivery website, branding, logo, and original documentation are owned by FastDelivery and protected by intellectual property laws. The boilerplate code includes open-source dependencies that are subject to their respective licenses.

You retain ownership of any applications you build using FastDelivery. We claim no ownership over your derivative works, provided you comply with the license restrictions in Section 6.

8. Acceptable Use Policy

You agree NOT to use FastDelivery to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Distribute malware, viruses, or harmful code
• Engage in fraudulent activities
• Harass, abuse, or harm others
• Scrape, copy, or reverse engineer our Service
• Create applications that violate third-party terms of service (AWS, etc.)

9. Third-Party Services and Dependencies

FastDelivery integrates with and requires third-party services including but not limited to:

• Amazon Web Services (AWS)
• Lemon Squeezy (payments)
• Various open-source libraries and packages

You are responsible for complying with the terms of service of these third-party providers. We are not responsible for changes, interruptions, or termination of third-party services that may affect your use of FastDelivery.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless FastDelivery and its affiliates, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney's fees) arising from or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Applications you build using FastDelivery

13. Termination

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the Service or our support team
• Chargeback or payment disputes

Upon termination, your license to use FastDelivery terminates, and you must cease all use of the code and delete all copies in your possession.

14. Changes to the Service and Terms

We reserve the right to modify or discontinue the Service (or any part thereof) at any time with or without notice. We may also revise these Terms from time to time. If we make material changes, we will provide notice by updating the "Last updated" date at the top of this page.

Your continued use of the Service after any changes indicates your acceptance of the new Terms. If you do not agree to the revised Terms, you must stop using the Service.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions.

15.2 Dispute Resolution

Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration or in the courts of Italy, as required by applicable law.

15.3 European Users

If you are a consumer based in the European Union, you may have additional rights under local consumer protection laws.

16. Miscellaneous

16.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and FastDelivery regarding the Service and supersede all prior agreements and understandings.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

16.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

16.5 Language

These Terms are written in English. Any translations are provided for convenience only. In case of conflict, the English version prevails.
